Agoura Hills Jogger Killed in Oak Park Car Accident

When emergency personnel first arrived at the scene of the car accident at Lindero Canyon Road in Oak Park, they didn’t even know there had been a jogger involved until they saw her shoes lying on the sidewalk. The rescue crew had to use special thermal cameras, and chainsaws to locate and extricate the woman, lying dead, trapped beneath thick vegetation, after being struck by a motorist.

The driver Nicholas LaGrotta, a resident of Santa Rosa Valley was driving his Subaru Forester on the road near Bowfield Street at 6:30 am when he apparently lost control, and veered off the road. The car plowed through signs and thick brush growth before coming to a stop. Karey Marsh, a 46-year-old Agoura Hills resident was jogging on the jogging path near the road, and was hit by LaGrotta’s car. According to the Ventura County Sheriffs’ Department, she was thrown at least 30 feet in the air. Her body fell deep inside the brush, where it lay until emergency personnel responding to the car accident found her shoes, and suspected that more than one person had been hurt. Her location was determined by thermal cameras. Chainsaws were used to cut though the brush to extricate her body.

LaGrotta himself suffered three broken vertebrae’s and several abrasions. He told police that he had no idea that he had hit somebody. He was taken to the hospital, and after blood alcohol tests determined that he was driving under the influence of alcohol, was arrested for vehicular manslaughter and driving under the influence.

Meanwhile, friends who knew Marsh remember her as a woman who was always pushing others to put their health and fitness first. An avid fitness enthusiast, she was a familiar sight to joggers in the area, and had been teaching fitness classes at a local gym facility. She was a fun loving person, whose zest for life was unmatched, friends told the media.

From all accounts, Marsh seems to have been full of enthusiasm, with a great deal to offer the world. This woman could have been a great contributor to society. None of her dreams will be realized anymore, because one reckless 23-year-old saw it fit to get drunk at 6:30 am in the morning, and head on out in his car. What kind of irresponsible behavior is it to be out at that hour in the early morning when you’re in no state to drive?

The impact of the drunk driving accident was immense, judging from the fact that Marsh’s body was thrown so far, it was discovered only a while later. We have no way of knowing yet if death was instantaneous, or whether she spent agonizing moments trapped in the brush, waiting for help. LaGrotta, on the other hand was quite lucky. He not only escaped with moderate injuries, but also managed to get the emergency treatment that he needed. Karey Marsh didn’t have that luxury.

For his irresponsible and reckless behavior, we hope that the law takes a firm stand against LaGrotta.

Good Samaritan Injured in Long Beach Car Accident Making Recovery

Just when we thought Good Samaritans exist only in the scriptures, comes an example to prove us wrong. A young man is discovering to his relief that he will, in time, be able to walk again, after being hit by a car on the freeway when he got out to help another motorist who had just met with a car accident.

On June 29, Johnnie Metcalfe was on the 710 Freeway in Long Beach, when he noticed that the car next to him lost control and rolled over to the side. Ignoring all his instincts about own safety, Metcalfe got out and rushed to help the driver of the Pontiac. It was 5:40 am and the driver was shaken, but fine. As they waited for the cops to arrive, a Mercury Mountaineer racing down the freeway headed straight for the group. Ever the Samaritan, Metcalfe pushed the Pontiac driver and another motorist who had stopped to help, out of the way. He took the full impact of the car accident when it happened.

The car hit him in the shin, ripping his feet from his legs, and smashing his bones. The other motorist, who had stopped to help too, was injured in the car accident. His lungs were punctured, and he suffered fractures.

The driver of the Mercury drove on a little further after the accident, and then retuned. By this time, cops had arrived, and they noticed that the driver Ryan Cruz Visita was red faced and, had watery eyes and reeked of alcohol. When asked if he had been drinking, however he denied it. Only after a test proved that he was indeed drunk did he admit that he had “a beer.”

He has been booked for DUI at the Los Angeles men’s central jail.

Metcalfe has been discharged from the hospital where doctors were able to re attach his feet. They have high hopes for his complete recovery, although it will take months of extensive rehabilitation for him to begin walking again.

In the midst of this tragedy, Metcalfe has seen it in himself to find strength in his trouble, not for himself but to help others. He has started an organization for the other drunk driving victims – not the people like him, who suffer physical injury due to the actions of drunk drives, but the family members of the drunk driving accident offenders, who are often left helpless after their family member has been implicated in a drunk diving accident. Like Visitas, for instance. His family has been unable to cough up the $160,000 bail amount that has been set for him. Metcalfe’s organization is called fittingly enough Dumb Dads Dangerous Decisions 2 Drink and Drive. The organization plans to assist family members of a person charged in a drunk driving accident to raise bail money, besides offering the emotional support that they need.

Ironically enough, while everybody is singing Metcalfe’s praises for what he did to help a fellow motorist in trouble, the California Highway Patrol has an entirely different take on things. If you see an accident on the freeway, they advise, simply call the police on your cell phone, and drive on. Don’t turn around, and definitely, NEVER get out of the car.

Boxer Involved in Costa Mesa Car Accident Charged

In July this year, we reported on Quentin “Rampage “Jackson, the boxer and former Ultimate Fighting Championship title holder who caused a traffic rampage in Costa Mesa, plowing his car into several other vehicles as he tried to flee the scene of a hit and run accident. Jackson was charged yesterday with several criminal counts stemming from the crashes that he caused as he drove through his widely publicized run from the law.

According to the Daily breeze, the charges include one felony count each of evading while driving recklessly, evading a peace officer and driving against traffic, and three misdemeanor counts of hit and run with property damage and another misdemeanor charge of reckless driving.

The rampage was widely reported in sports media, and provided fodder to the comedy circuits and talk shows for weeks later. The circumstances under which Jackson’s strange behavior erupted were interesting. Just days earlier, he had lost his title as the “Ultimate” world champion. The chase started after Jackson crashed into two cars at the 55 Freeway and 19th Street intersection. He immediately fled from the scene of the car accident. By this time, police were on his tale, and the boxer continued to rampage his way through, sending pedestrians scurrying for cover as he drove his car up onto the sidewalk. He continued to drive on even as one of his tires blew out, driving on a rim. To add to all the drama was a life sized cut out of the boxer that was prominently displayed on the side of this pickup.

Given Jackson’s erratic behavior, it was easy to suspect that he was under the influence of intoxicants, but there seemed to be no evidence of any alcohol or drugs involved in car accident. Soon after, Jackson was booked on charges of reckless driving, hit and run and felony evading. He was later released on a bail of $25,000.

Investigations after the accident focused on a number of misdemeanors that Jackson was found to have caused as he drove from the police. One woman, who had been in one of the vehicles that were sideswiped by the boxer’s pickup, alleged that the accident had caused her to have a miscarriage a few days after the car accident. Investigators have seemed to have found no evidence to link her miscarriage to the impact of the accident.

Another angle that police explored further was the claim by some of Jackson’s friends and associates that he had been displaying strange behavior in the days leading up to the car accident. The stress of the loss of the heavy weight championship after which he was heavily criticized by his manager, his friends felt, had taken a toll on his mental health. Police took him to the hospital for mental evaluation, and details of that evaluation have not been released due to confidentiality reasons.

That this car accident remained not a very serious one is entirely a matter of good fortune of those who were involved in the series of collisions Jackson caused that day. There could very well have been fatalities in an accident of this nature. The sort of reckless behavior that Jackson displayed could have ended with worse results that we have seen here. To ensure that the man is not tempted to manifest more signs of machismo on the streets again, he should be held totally accountable this time.

Police Say Senior Citizen Killed in Fresno FAX Bus Accident Had Right of Way

Fresno police investigations have confirmed that a man killed in a pedestrian accident involving a Fresno Area Express (FAX) bus on Friday apparently had the right of way at the time of the accident.

The accident, the first fatal one involving a FAX bus in the last 18 years occurred at M Street. The FAX bus was making a turn onto M Street from Fresno Street. The driver, it appears, was busy looking at another pedestrian at the intersection, and failed to notice the man, 74-year-old Eloy Padilla-Ortiz who was crossing M Street at the same time. Padilla-Ortiz crossed at a green light, and went unnoticed by the bus driver. The driver, police investigators now theorize, was expecting to stop at the intersection, but instead the light turned green and he turned into the intersection. This means that Padilla-Otriz was in the right, since the light had turned green.

As the accident occurred, the left corner of the bus clipped Padilla-Ortiz. His legs were crushed by the rear wheels of the bus. He died soon after from the injuries sustained during the pedestrian accident.

This is the first fatal accident involving a FAX bus since 1990. In November of that year, a motorist ran a red light causing an accident with a FAX bus. Just two years earlier, a bicyclist was struck by a FAX bus. Since 1990, there have been no fatalities reported involving these buses. According to protocol, when a driver of a FAX bus is involved in a bus accident, he or she is immediately placed under paid administrative leave. No comments are made, and the investigation is deemed as a personnel matter, until all the investigations, including those of the FAX and the police investigations are completed.

The Amalgamated Transit Union, which represents 400 Valley drivers and employees, insists that it will work to protect the rights of the driver. The union expresses sympathy for the victims’ family, but urge the public to remember that their drivers have been driving without causing any untoward incidents for many years.

Even so, a 74-year-old senior citizen was knocked down and run over causing his death. Nothing can change that. Eighteen years of a stain-free record doesn’t completely absolve the driver involved of his very apparent negligence here. For Padilla-Ortiz’s family, the circumstances of his death are surely an extremely painful one. This is not how you imagine the elderly in your family meeting their end. You wish for them to be safe and comfortable in their home, surrounded by the people who love them.

Padilla-Ortiz’s death was entirely avoidable. If not for the driver’s negligence in not being fully aware of the conditions of the streets before he headed right ahead, the man would still be with his family. The Union seems to have made it clear that they intend to seek justice for their driver. We hope, Padilla Ortiz’s family seeks justice for him.

Man Charged in Arroyo Grande Drunk Driving Accident

Yet another drunk driving accident, this time in Arroyo Grande, killed one person, and seriously injured two others. The accident occurred Sunday morning on Highway 101 off El Campo Road.

The accident, apparently, was waiting to happen. According to reports, the car driven by 28-year-old Apolinar M. Rodriguez, a Watsonville resident, was seen by many motorists to be driving erratically, southbound on the highway. Some of the other motorists called 911 to inform police about the reckless driving. Rodriguez was with two other occupants in the car.

California Highway Patrol officers managed to locate the Honda, and were in the process of coordinating with units when the car suddenly turned to the right. Rodriguez at this point, seems to have lost control of the car, and it went off the highway, and down a 30 foot embankment. When it crashed into the bottom of the embankment, the Honda rolled over. One passenger was ejected from the vehicle, while the others were still trapped in the car.

When California Highway Patrol officers arrived at the scene of the drunk driving accident, they found the two passengers still in the car. The front seat passenger, who has not yet been identified, was dead. A small fire broke out in the engine, but CHP officers managed to douse the flames before there was an explosion. Both Rodriguez and the other passenger Benito Salvador, were taken to the hospital for treatment of multiple severe injuries they suffered in the drunk driving accident.

Officers, suspecting that Rodriguez was driving under the influence of alcohol, have arrested him on suspicion of felony drunk driving and manslaughter.

This is yet another instance of how drunk driving kills – not just people walking on the sidewalk, or occupants of drivers of other cars you come in contact with, but unwittingly enough, even your own friends and relatives sharing your car. The victim of this drunk driving accident no doubt, didn’t think twice about getting into a car with a man who was visibly drunk, and in no condition to drive. He has paid for this mistake with his life

It’s a hard lesson to learn, and this unfortunately is how many youths seem to learn this message. For them, there is no dawning awareness of the dangers of drunk driving – one resounding crash, the shattering of glass, the screech of brakes and then, death. It’s unfortunate that the split second before they die is when so many people realize that they made a horrible mistake drinking, or getting into a car with a drunk driver at the wheel. By then, of course it’s too late.

Rodriguez has much to answer for, from his victims’ family and his own conscience. This young man will have to live knowing that he killed his own friend.

Convicted DUI Offender Kills Two in Motorcycle Accident

Take a history of alcohol and drug abuse, post traumatic stress disorder, and a disposition to never learn from his mistakes, and put all these behind the wheel of a car, and what do you have? A drunk driving accident of the mindless sort that happens every day on our streets. 58-year-old Jimmy Dunn is currently being held at a Pinellas County jail in Clearwater, Florida on charges of driving under the influence of alcohol and manslaughter.

On Tuesday night at 9:45 pm, Dunn was in his car, driving north on Keane Road. He had just had his driver’s license reinstated. Dunn drove right into a motorcycle with two men riding on it. The motorcycle rider, Harold Davis, was not wearing a helmet. His pillion rider, Jason Hennis was. When the dust from the collision had settled, it really didn’t make a difference to either of the men. Davis died at the scene of the motorcycle accident. Hennis died at the hospital about an hour late.

Dunn drove off from the scene of the motorcycle accident, but was caught by passersby, who happened to witness the accident. Police when they arrived, found the strong smell of alcohol on his breath and after blood alcohol tests were given, the results showed that the count was at .179 and .186. Apart from the influence of alcohol, there are also suspicions that Dunn may have been under the influence of cocaine at the time of the motorcycle accident.

Dunn’s history of driving while intoxicated and a host of other offenses is lengthy to say the least. In the matter of drunk driving alone, he has been convicted on three separate occasions. On each occasion, his license was revoked, each time for a longer and longer period of time. He only got his license back last year after a 10-year revocation of his license after his last drunk driving conviction.

Not that not having a valid license prevented Dunn from driving. He was arrested in 2006 on charges of driving with a revoked license and spent a night in jail. It was after his third conviction for DUI, that the words “substance abuse” came to be associated with Dunn. He underwent a drug evaluation, and was labeled a heroin and cocaine addict. The substance abuse seems to have been intense, and led to Dunn losing his family, as well as his job.

His record also mentions that he suffered from post traumatic stress disorder for which he had received treatment at the VA Medical Center at Bay Pines. He stopped attending therapy after he found it was interfering with his job, this was just before his third and last DUI conviction.

All this means nothing to the families of the two men who died, however. They don’t care how many times his license was revoked, or what kind of stress disorder he was suffering from. All they know is that they have lost a son, a husband, and a father each. Davis and Hennis were not in the wrong here. They were perfectly sober, going about their daily business. It was Dunn who was allowed to be back behind the wheel of a car even after the number of convictions that he had to his name. This was a man who shouldn’t even have been behind the wheel of a stationery vehicle. Instead, he’s managed to cause yet more havoc and destruction because we fail to treat these offenders with the extreme strictness that they deserve.

Brentwood California Dangerous Road Kills One

It was a combination of speed and a dangerous road, that killed a Clayton resident on Wednesday in Brentwood. William Tindall was killed when he stopped his car to help another motorist in trouble. He was himself struck by another car, and died at the scene.

The accident occurred on Wednesday on Marsh Creek Road. 56-year-old Tindall, a plumber by trade, was on his way to Stockton to look at a new hospital renovation job. On the way, he chanced upon another motorist Daniel Lew whose car went off the road, and ended up in an embankment. Tindall stopped his car, and got down to offer the stranded motorist his help. When he had been able to send Lew on his way, a speeding car struck him.

Tindall’s death is just the second fatal accident in five days, on the road that is being currently used by motorists who wish to avoid the congested Highway 4. The highest number of fatalities on this road occurred in 2005 with a total of three fatalities. After those fatalities, the state Office of Traffic Safety gave the county a one-year grant for road upgrades. The construction work that’s progressing on Marsh Creek road has led to a great deal of gravel being positioned on the road, decreasing the amount of traction that motorists driving that way receive.

Motorists who use the road frequently are aware that this is a dangerous road. Tindall himself, his wife says, was very aware of the dangers of driving on a dangerous road filled with construction debris that was a potential death trap for unsuspecting motorists driving at a high speed. There have been complaints that motorists have made about the dangerous road and the fact that it’s a magnet for accidents.

Tindall’s death has now jolted the California Highway Patrol and the county police officers into action. They have decided to put new traffic rules into effect on the road, beginning today. As of today, between 8 am and 10 pm, all traffic passing along Marsh Creek Road will be escorted by pilot cars to ensure that all vehicles stick to a safe 25 mile per hour speed limit. Between the hours of 10 pm and 4 am, the road will close to all traffic, except residents who will be allowed to use the road. Between the hours of 4 am and 8 am, California Highway Patrol officers will drive traffic though the road. Traffic authorities expect some delays because of the new traffic rules, especially at the exit points. Regardless, this is going to be potentially life saving measure for motorists on that stretch of dangerous road, and nobody is likely to complain about any delays.

For Tindall, however, these rules have come too late. It’s unfortunate that there have to be fatal accidents taking place before any concrete action is taken to prevent any more accidents. Motorists have been complaining for a while now about that dangerous road. We fail to understand how the authorities responsible could have turned a blind eye to the dangers of the road. We are sure William Tindall’s family doesn’t understand either.

Woman Charged in Church Van Drunk Driving Accident

Two women in their eighties, were among those injured in a drunk driving accident in Shelby, North Carolina. The accident involved a car and a church van, filled with church members. The seven members in the van belong to the Light Oak Missionary Baptist Church. The members had all been to a revival in Blacksburg, South Carolina, and were returning home when the accident occurred in Shelby. The church van that they were traveling in collided with another car just after 10 pm on Tuesday.

There was extensive damage to the van itself. The windshield was cracked, and the front end was crushed. There were at least two deflated air bags. The senior citizens inside however, escaped with minor bumps and small injuries. Among those injured were two women in their eighties, who suffered cuts.

The accident occurred close to the church’s location. The driver of the other car, Kelly Bowman was driving a 2006 KIA. According to a church member in the van, she saw Bowman’s car veer in and out of her lane just before the accident. The car came right at the van head on, but for the driver it was too late to avoid a head-on collision. At least 9 people were taken to Cleveland Regional Medical Center.

Bowman meanwhile was trapped inside the car after the drunk driving accident. She was taken to the hospital for treatment for minor injuries, and was released a few hours after the accident. She has been charged with driving while intoxicated as well as driving left of center. She claims that she was only driving at 20 miles per hour, and was just trying to reach for something in the back seat when the accident took place. She did admit though, that she had a little grape vodka to drink before she got behind the wheel. She denies that she was drunk, however, claiming that it was just a couple of sips as she headed out the door, which is why the officers smelled it on her breath, and charged her.

This isn’t a first time offense for Bowman, nor is it the first time she’s pled guilty to drunk driving. She was accused of the same act back in 1999, when she had pled guilty to charges of drunk driving.

That there were no more severe injuries or even a fatality in this drunk driving accident is more a matter of good luck than anything else. The age of the passengers inside the church van, all aged above 50, and some in their eighties, could have easily caused more severe injuries to take place. The extent of damage to the van was quite extensive. “Once bitten twice shy,” you would have assumed, but apparently it’s not the case with Kelly Bowman. This is a woman who has been charged with drunk driving before. You would expect that this mother of five would take it on herself to be more careful on the streets, and never drive in a state of intoxication again. Instead she’s back in the same situation barely 9 years later, making the same excuses for her behavior. There are definitely grounds for a personal injury lawsuit here, and we hope the church members involved in the accident will take legal action against Bowman.

Volunteer Killed in Oakland Drunk Driving Accident

A giving soul, always generous with his time and skills to help those less fortunate across the world – that’s what Scott Leister’s family now has to remember as. The 21-year-old was killed Sunday morning in a drunk driving accident involving his car and a Subaru on the San Francisco – Oakland Bay Bridge

Scott, a graduate of the Athenian School in Danville, was retuning home from a visit to San Francisco at the time of the accident. He was with his brother Chris as well as two friends. At about 2:20 am Sunday morning, the car was apparently slammed into by a Subaru Impreza from behind. The impact of the crash sent both cars spinning out of control, and both cars slammed against the bridge railing. Scott, who happened to be sitting in the back seat, received the full force of the impact. He was pinned inside the car, and died at the scene of the accident.

The Subaru meanwhile burst into flames, and the driver, 22-year-old Jerell Puno, was barely able to make an escape from the damaged car before it exploded into flames.

Scott’s brother and two friends have been admitted to Highland Hospital in Oakland. Puno, a resident of Fairfield, was found to be under the influence of alcohol at the time of the accident. He was arrested and charged with vehicular manslaughter, and driving under the influence. According to witnesses, who saw the Subaru on the lower deck of the bridge just before the accident, the man was doing 100 miles per hour when his car slammed into the Mercedes Benz. He has posted a bail of $102,500 and has been released from the Alameda County Jail.

At the time of the drunk driving accident, Scott was involved in preparing himself for a life dedicated to service and helping others. He had been on a break from learning wilderness skills and environment education at the National Wilderness Leadership School. This young man’s life was definitely well-lived, with Scott having spent a considerable portion of his high school and later college years, involved in volunteer work in some of the poorest regions in Central America. He was skilled with his hands, and put his carpentry skills to use in these places.

Apart from foreign volunteer service, Scott also volunteered with the Bay Area Mountain Rescue, a San Francisco bay area search and rescue team. According to his mother, Scott had plans for continuing with volunteer and service work in the country and abroad. He had just obtained his wilderness emergency medical technician license, and had been full of plans for his future when the accident took place.

His parents have made arrangements for a funeral for their son which will be held on Saturday, and have set up a memorial fund to continue the work he left behind so suddenly. Meanwhile Puno, whose rash behavior has cost another his life, is out on bail, and in the comfort of his own home, no doubt thanking his stars that he was lucky this time around. The world needs more Scott Leisters. Unfortunately, we have one less person who cared about society, and one more drunk driver in his place.

CHP Program for Awareness of California Motorcycle Accidents

More motorcycles on the streets of California, and older drivers who have slower reflexes – a potent combination of factors that have led to an increased number of motorcycle accidents in many areas across the state.  Now, the California Highway Patrol has kicked off a program that aims to increase awareness for the need for better motorcycle safety practices on our streets. The program called “Saving Lives in California” includes five areas in its fold, and will continue though this month.

The California Highway Patrol has identified a few areas as being especially vulnerable to motorcycle accidents.  All through this month, patrol officers will be vigilantly looking for errant motorcyclists, and educating drivers about the proper methods of sharing the roads.

The program couldn’t come a day too soon.  The number of motorcycle accidents taking place in California, the state with a tradition of motorcycling that goes back decades, has increased dramatically. In 1998, the number of people killed in motorcycle accidents was 206. By 2006, the number had risen to 511. Of course, as the California Highway Patrol points out, the number of motorcycle registrations during the same period rose by 72 percent.  The number of increased motorcycle accidents therefore can be traced to the fact that there are simply more motorcycles on the streets these days.

Even among motorcycle owners, there is a distinctly different kind of motorcycle rider these days that has the CHP worried. The number of older motorcyclists has risen around the country, and the same is true for California.  As one patrol officer puts it bluntly, when you dust off the motorcycle, you also had better take some motorcycle safety lessons to brush up your knowledge of riding.  With more older men choosing to celebrate the new found independence that comes when they have completed a good part of child rearing and can concentrate on themselves, there is a breed of motorcyclists who form a potentially high-risk group for such accidents.  A 40-year-old motorcyclist just doesn’t have the sort of reflexes and quick judgment that a 25-year-old would.  Add to that the fact that the machines themselves these days are stronger, meaner and more powerful, and you have a recipe for a motorcycle accident.

So far, it looks as though the program is going according to plan. In the Santa Fe Springs area alone, CHP officers have cited 108 motorcyclists so far. Other areas that have been identified by the CHP in this program are Baldwin Park, Altadena, Central L.A. and West San Fernando Valley.  From crossing the yellow lines, to riding without a license, motorcyclists are being given a crash course on what is not acceptable on the streets.

An initiative like this from the California Highway Patrol was a long way coming.  Better education can only mean safer streets for both motorcycle and drivers alike.
